Drunk Driving Law Update

The Michigan Supreme Court issued its opinion in the People of the State of Michigan v Gino Robert Rea, finding that operating a motor vehicle in your private driveway is a violation of the Michigan statute prohibiting drunk driving: MCL 257.625.  The Michigan Supreme Court found that a private driveway, including that portion of the driveway between residences, was “generally accessible to motor vehicles” as required in the statute and as such, the defendant in the case, who merely backed his motor vehicle out of his detached garage, never leaving the driveway, could be charged with drunk driving.
